Terms of Service

1. Provider and agreement

These Terms govern your use of the RateMyFit mobile app, website, waitlist, and related services (the "Service"). The Service is provided by Jeremy Poroye, Vaalser Straße 13, 52064 Aachen, Germany ("we", "us", or "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. Mandatory consumer rights that apply where you live remain unaffected.

2. What RateMyFit does

RateMyFit lets you submit outfit photos, receive AI-generated scores and styling feedback, ask an outfit coach questions, save results, and review progress over time. Available features and usage limits may depend on your plan, platform, country, or app version.

Early-access, alpha, beta, or TestFlight versions may be incomplete, change frequently, and contain errors. Feedback you voluntarily provide may be used to improve the Service.

3. Eligibility

You must be at least 13 years old, or at least 16 in the European Economic Area unless a parent or guardian lawfully authorizes your use. If you are under the age of legal majority where you live, a parent or guardian must agree to these Terms on your behalf.

4. Your account

• Provide accurate information and keep your sign-in method secure.
• You are responsible for activity carried out through your account.
• Tell us promptly at support@ratemyfit.app if you believe your account has been accessed without permission.
• You may not sell, transfer, or create accounts for automated abuse.

5. Subscriptions, trials, and billing

• Paid plans are offered through the Apple App Store or Google Play. The price, billing period, included features, and any trial are shown before you confirm a purchase.
• Unless the offer says otherwise, subscriptions renew automatically for the displayed billing period until canceled through the store account used to purchase them.
• A free trial converts to the displayed paid subscription unless canceled before the trial ends. The store controls billing timing and eligibility for repeat trials.
• Cancellation normally takes effect at the end of the current paid period. Refunds and statutory withdrawal rights are handled under applicable law and the rules of the store through which you purchased.
• Deleting the app or your RateMyFit account does not cancel store billing. You must cancel the subscription separately in your Apple or Google account.

6. Your content

You keep ownership of photos, messages, and other content you submit. You grant us a limited, worldwide, non-exclusive license to host, copy, adapt, transmit, and process that content only as needed to operate, secure, and improve the Service and provide the features you request. This license ends when the content is deleted, except for limited backup, security, or legal retention described in our Privacy Policy.

You confirm that you have the right to submit the content and that it does not:

• violate another person's privacy, image, copyright, or other rights
• contain unlawful, abusive, exploitative, or sexually explicit material
• contain malware or be submitted to interfere with the Service

Do not upload a photo of another person without their permission. We may remove content that violates these Terms or applicable law.

7. AI-generated feedback

Scores, labels, explanations, and coach responses are generated with automated systems. They may be incomplete, inconsistent, subjective, or wrong. The Service provides general style information and entertainment, not medical, psychological, legal, financial, or other professional advice.

You remain responsible for decisions based on the output, including purchases or how and where you wear an outfit. Do not use the Service to make consequential decisions about another person.

8. Acceptable use

You must not:

• use the Service unlawfully or infringe another person's rights
• probe, attack, overload, disrupt, or bypass security or usage limits
• use bots, scrapers, or automated requests without our written permission
• reverse engineer the Service except where applicable law expressly permits it
• circumvent subscriptions, quotas, authentication, or account restrictions
• impersonate another person or misrepresent your connection to them
• resell the Service or use it to train a competing model without permission

9. Our intellectual property

The Service, software, visual design, text, branding, and other materials we provide are owned by us or our licensors. We give you a personal, limited, revocable, non-transferable license to use the Service for its intended purpose. No other rights are granted.

10. Third-party services and app stores

The Service relies on third-party platforms, AI providers, authentication services, payment infrastructure, and app stores. Their terms and privacy policies may also apply to your relationship with them. We are not responsible for third-party services outside our control, but this does not limit any responsibility we cannot exclude by law.

11. Privacy and account deletion

Our Privacy Policy explains how we process personal data. You can delete your account in the app under Settings → Account & Subscription → Delete account, or use our account deletion page. Account deletion is permanent. Store subscriptions must be canceled separately.

12. Availability and changes to the Service

We may update, add, limit, or discontinue features for legitimate product, security, legal, or operational reasons. We do not promise uninterrupted or error-free operation. If a material change negatively affects a paid feature, any mandatory remedies under consumer law remain available.

13. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access where reasonably necessary to protect the Service or others, comply with law, address non-payment, or respond to a material or repeated breach of these Terms. We will provide notice where reasonably possible and legally permitted.

14. Warranty and liability

Statutory warranty and consumer rights apply. Subject to those rights, the Service and AI output are provided without a promise that every result will be accurate or suitable for a particular purpose.

We are liable without limitation for intent, gross negligence, injury to life, body, or health, fraud, and liability that cannot legally be limited. For simple negligence, we are liable only for breach of a material contractual obligation and only for the foreseeable loss typical for this type of contract. A material obligation is one whose performance makes the contract possible and on which you may ordinarily rely.

15. Changes to these Terms

We may update these Terms for legal, security, or product changes. We will update the date above and give reasonable advance notice of material changes where required. If you do not agree to an updated version, you may stop using the Service and delete your account before it takes effect.

16. Governing law and disputes

German law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not deprive you of mandatory protection under the law of your habitual residence. You may bring claims in any court that has jurisdiction under applicable consumer law.
